Privacy Policy of Helitrends’ Mobile Application and Website

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (General Data Protection Regulation) (hereinafter “GDPR”), in this this document (hereinafter “Policy”), we inform you about the principles of personal data processing and the use of cookies by Helitrends sp. z o.o., Wojska Polskiego 9 street, 39-300 Mielec, Poland, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court in Rzeszów, XII Commercial Division of the National Court Register, under the KRS number: 0000842161, using the NIP (tax identification number) 8172196708, share capital: PLN 5.000,00, who is a controller in the meaning of GDPR of your personal data (hereinafter “Controller”) within Helitrends’ mobile application (hereinafter “Application”) and the Controller’s website (hereinafter “Website”).

Purposes of personal data processing

The scope and principles of data processing differ depending on the purpose of data collection. The following are the specific purposes of the processing of personal data (such as first name, last name, e-mail address, company, other data that you place in the Application or Website):

1. in order to conclude and perform an agreement concerning the Application concluded between you and the Controller - on the basis of art. 6(1)(b) GDPR (agreement);
2. in order to fulfill the legal obligations incumbent on the Controller, in particular tax or accounting regulations – on the basis of art. 6(1)(c) GDPR (legal obligation);
3. in connection with the following legitimate interests pursued by the Controller or by a third party, (i) in order to conduct marketing, analytical and statistical activities by the Controller (e.g. presenting you advertisements and offers, also tailored to your interests); (ii) ensuring the highest quality and safety of the services provided, including within Application or Website; and (iii) possible claims and defense of rights related to the activity conducted by the Controller; (iv) to respond to your inquiry or process a complaint or a request – on the basis of art. 6(1)(f) GDPR (legitimate interest).

Providing personal data is voluntary, but necessary in order to fulfill the purposes indicated above; in particular, providing personal data is necessary in order for you to use the Application (concluding a contract with the Controller).

The Period of personal data storage

Your personal data (i) in connection with the agreement concluded between you and the Controller will be stored - for the duration of the concluded agreement, (ii) in connection with marketing, statistical and analytical activities - for the duration of the legitimate interest of the Controller or the third party, or until you object to such processing. In addition, your personal data may also be processed for the time necessary to (iii) fulfill the Controller's obligations under applicable law, and (iv) investigate or defend against any claims.

Depending on the scope of personal data and the purposes of their processing, your personal data is stored for a different period. The longest storage period is decisive in each case.

In addition, within the newsletter your personal data will be processed as long as this service is in operation. You have the option to resign from the newsletter at any time. For this purpose, you must choose the option to resign from receiving the newsletter in the message received or contact the Controller.

Information about profiling and your rights

Your personal data will not be subject to profiling (i.e. automated data processing).

With regard to the personal data, you have the right to request access to the personal data processed by us, to rectify, transfer, delete or limit the processing of your personal data.

You may also object to the processing of your personal data (in the case of personal data processed on the basis of a legitimate interest) or withdraw your consent, at any time, to the processing of your personal data based on your consent. Withdrawal of your consent to the processing of personal data does not affect the lawfulness of the processing which was carried out on the basis of consent before its withdrawal.

You also have the right to lodge a complaint with the data protection authority.

Data transfers to third parties, outside the european economic area

The Controller informs that he uses the services of external parties. Entities entrusted with the processing of personal data shall guarantee the implementation of appropriate personal data protection required by the law, in particular by the GDPR.

We may provide your personal data to entities providing IT, legal, accounting, marketing and payment services to Controller, including the following entities:

1. dhosting.pl sp. z o.o., Al. Jerozolimskie 98, 00-807 Warsaw, Poland - in order to store personal data collected through the website and e-mail boxes,
2. Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland - to use Firebase, where Application’s users databases are located,
3. Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA
4. The Rocket Science Group LLC d/b/a Mailchimp, 675 Ponce de Leon Ave. NE, Atlanta, Georgia 30308, US - to send emails to subscribers and communication issues,
5. to other external partners on the basis of the permission given by you or on any other appropriate basis.

We may transfer your personal data to countries outside the European Economic Area (“EEA”) and in any such case, we check whether the third country ensures an adequate level of protection of personal data or we use other appropriate transfer safeguards in the form of standard contractual clauses adopted pursuant to a decision of the European Commission. Cookies and other technologies

Application or Website uses cookies or other technologies with functionality similar to cookies (hereinafter collectively as "Technologies"), to make it easier for you to use the resources on our Application or Website. In addition, Application or Website uses cookies for statistical and analytical purposes and to ensure the proper functioning.

Technologies contain useful information and are stored on your device - our server can read them when you reconnect to this device. Besides the necessary Technologies (which are used by us to guarantee the proper operation of the Website or Application and safe use of it - and for which we do not need your consent), other Technologies may also be used as part of the Application or Website - for which we need your consent.
